Homes4All s.r.l. Società Benefit (hereafter referred to as the “Controller” or “Company”), as the data controller, informs you pursuant to Art.13 of EU Regulation No. 2016/679 (hereinafter, “GDPR”) that your data will be processed in the following ways and for the following purposes:

  1. Processing information

The Controller processes the identification data and usage data of the data subject generated during the interaction with the Controller’s website (the “Site”), accessible at the following address https://homes4all.it/ – hereafter, “personal data” or also “Data”.

The Site is also capable of tracking certain information related to the network used by the User (e.g. IP address).

  1. Purpose and Legal Basis of the Processing

Your personal data is processed for the following purposes:

  1. a) allow the user to send messages to the Controller through specific contact forms in order to ask questions and/or submit requests;
  2. b) interact with a specific form to perform the “guaranteed rent free simulation” and obtain more information on the property management service;
  3. c) acquire statistics and metrics aimed at ensuring the correct operation of the Site;
  4. d) exercise the rights of the Controller (for example, the right to legal defense).

The legal bases for the aforementioned processing are the following:

  • Regarding purposes a) and b), the processing is necessary for the execution of a contract in which the data subject is party or for the execution of pre-contractual measures taken at the request of the data subject;
  • Regarding purposes c) and d), the legal basis is the Legitimate interest of the Controller, namely to monitor the proper functioning of the Site and to exercise the rights of the Controller such as legal defense.

Providing data for the aforementioned purposes is optional. In the event of non-communication of the Data, it will not be possible for you to interact correctly with the Site.

In addition, your Data may be processed only with your specific and distinct consent (Art. 7 GDPR), for the following Marketing Purposes:

  1. e) Send the user mail and promotional communications.

Providing Data for Marketing Purposes is voluntary and optional. You may therefore decide not to provide any data or to later refuse the possibility to process Data already provided: in this case, you will not be able to receive offers related to the Services offered by the Controller. You can withdraw your consent to data processing at any time without affecting the legality of the processing based on consent before the withdrawal.

  1. Data retention

Personal data will be stored for the time necessary to fulfill the purposes indicated in this notice. The Controller will keep a copy of correspondence of legal and commercial relevance for ten years, as required by the Civil Code. The user’s personal data may finally be kept for the time necessary to guarantee legal defense or to pursue any abuses in the use of this Site.

Data relating to newsletter subscribers will be processed until the data subject revokes their consent.

  1. Disclosure of personal data

The user’s Data will not be disclosed but may be made accessible, where necessary for the provision of services or by law:

  • to employees and collaborators of the Controller in Italy and abroad, in their capacity as subjects authorized to process personal data and/or system administrators;
  • to third-party companies or other subjects (for example, technology providers, professional firms, IT consultants, etc.) who carry out outsourcing activities on behalf of the Controller, in their capacity as external data processors.

The Controller may disclose your Data for the purposes referred to in art. 2 to supervisory bodies, judicial authorities, public bodies to which it is mandatory to communicate the Data, as well as to those subjects to whom communication is mandatory by law for the performance of said purposes.

  1. Data Transfer

Personal data is stored on servers located within the European Union, managed by third-party companies in charge and duly appointed as Data Processors.

The Controller may transfer some categories of User data to third countries outside the European Union. The Data will be transferred exclusively to countries deemed adequate by the European Commission or to companies that respond to the guarantees provided by articles 44 – 50 of the GDPR.

  1. Rights of the Data Subject

You may exercise the rights granted by the GDPR (articles 15-22), including:

  1. The right to receive confirmation as to whether the Data Controller is processing the User’s Personal data (access rights);
  2. The right to update, modify and/ or correct Personal data (right of rectification);
  3. The right to request the erasure of data or the restriction of the processing. This right can be granted if the process is unlawful or the Data Controller no longer needs the Personal data for the purposes of the processing (right to be forgotten and right to restriction of processing);
  4. The right to oppose to the processing (right of opposition);
  5. The right to propose a complaint to the Supervisory Authority in case of violation of the regulations regarding the protection of Personal data;
  6. The right to receive an electronic copy of the User’s Personal data (in a structured, commonly used and machine-readable format) and right to transmit those Data to another Data Controller without hindrance from the Data Controller to which the Personal Data have been provided (right to Data portability).
  7. Processing of Minors’ Data

In Italy, to use the property management service it is necessary to be at least 18 years old.

We do not intentionally collect information about minors under the age of 18 (in some jurisdictions, this age limit may be different). If we discover that a minor under the age of 18 has provided us with their personal data, we will delete the collected information.
